These Terms of Service (“Terms”) govern your use of the HYPERION website and analytics service (the “Service”) provided by HYPERION TRANSEUROPEAN ADVERTISEMENT LTD (“we”, “us”). By accessing or using the Service, you agree to these Terms.

1. The Service

HYPERION is an analytics platform that helps advertisers and agencies measure, compare and analyze the performance of their Meta advertising campaigns.

2. Accounts

You must be at least 18 years old and provide accurate information. You are responsible for keeping your access credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

• connect ad accounts you are not authorized to access;
• use the Service for unlawful purposes or in violation of third-party rights;
• attempt to gain unauthorized access to, disrupt or reverse engineer the Service;
• resell or sublicense the Service without our written permission.

4. Compliance with Meta terms

When connecting Meta ad accounts, you must comply with the Meta Platform Terms, Meta Advertising Standards and other applicable Meta policies. HYPERION is not affiliated with Meta Platforms, Inc.

5. Intellectual property

The Service, including its software, design and content, is owned by HYPERION TRANSEUROPEAN ADVERTISEMENT LTD and protected by law. You retain all rights to your data. You grant us a limited license to process your data solely to provide the Service.

6. Fees

If paid plans are offered, prices and payment terms will be agreed with you before purchase. Unless otherwise agreed in writing, fees already paid are non-refundable, except where required by law.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee any particular advertising results.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data. Our total liability is limited to the amount you paid us for the Service in the 12 months preceding the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. Upon termination, your data will be deleted as described in our Privacy Policy.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law rules. Disputes shall be resolved in the state or federal courts located in Delaware.

11. Changes

We may update these Terms. Continued use of the Service after changes means you accept the updated Terms.
